Terms and Conditions

 

Scope
These Terms and Conditions apply to all orders which you submit to Luxury Lights by CHS website. By placing an order, you are bound by these Terms and Conditions.

Orders
Your orders are subject to acceptance by the Company which is evidenced by an order confirmation from the Company. Order confirmation does not occur until a shipping notification is sent to you, or the purchaser, via the email address provided by you.

All orders for items sold are subject to availability.

Price and Payment
Prices may change at any time. If your order has been confirmed by the Company, any later price change will not affect your order.

Payment for all orders, unless otherwise agreed to in writing by the Company, must be made prior to order confirmation. Payment must be made through the payment services as determined from time to time by the Company. If the Company is unable to collect on your order through the payment service, the Company will invoice you and you agree to pay the amount payable within three (3) days from the date of the invoice with payment made in the manner designated on the invoice.

In addition to the price indicated on this website, you are responsible for and agree to pay any sales tax, other tax, other governmental levy, and in some cases, the cost of shipment and international customs duties and fees associated with shipment of the order.

Due to unforeseen circumstances there may be times when an item runs out of stock after an order is placed. We will always offer all available options to you in order to fulfill your order. There a times when we simply may not be able to fill an order. In these cases, the order will be cancelled and refunded as a store credit or refunded to your original purchase method at your request. If an order contains both in stock and out of stock items, we will contact you prior to shipment and inform you of all available options. If we do not hear back from you with 5 business days, we will ship the in-stock items, cancel the out-of-stock items, and issue a store credit for your purchase price on the out of stock items - or a refund back to your original payment method at your request.

Shipping Time
Most orders will ship within 24 hours (M-F only). During our busy season (October through February) shipping time may reach 24-96 hours or more from the time you place your order. Expedited orders (overnight, 2-day air) will be expedited and will be shipped within 24 hours of placing your order, usually on the same day the order is placed. During the last week of the year, you can expect longer than usual delays in order processing.

Installation services will be schedule as quickly as possible and payment will be required on the day of completion.

Orders are not processed or shipped on Saturday or Sunday or during inclement weather that does not allow our employees to safely get to work.

We cannot guarantee when an order will arrive. Any shipping or transit time offered to you by Luxuay Light by CHS, its website or other technologies or by any other parties, including the carriers themselves - is only as an estimate. We encourage you to order in a timely fashion to avoid delays caused by shipping, weather or product availability.

We DO NOT ship to PO Box addresses. If you enter a PO Box address and your package does not arrive, it will be likely be returned to us. At that point, we will either refund you the product purchase amount minus any unpaid cost for outbound and return shipping to us or we will re-ship the package at your expense once you have paid a second invoice for the cost of re-shipping to a non-PO Box address.

**Please note that all our wireframes are handmade and as such they can take up to 21 extra days or more of processing time prior to shipping, especially during the busiest months of October-December where production times can reach as much as 8-12 weeks.

Shipping Rates
Our shipping rates are simple. We pass through the real time rates provided to us by the shipping carriers. We also offer 2 day and overnight expedited shipping. Expedited shipping is not available for custom items, wireframe displays or items that must ship via freight.

From time to time, we may offer free shipping as a limited time promotion. Not all items will qualify for free shipping. Orders shipping to locations outside of the continental United States (including, but not limited to Hawaii, Alaska, and outlying U.S. Territories) do not qualify for any free shipping promotion.

For orders shipping to Hawaii, Alaska and outlying U.S. territories, all available shipping methods, including expedited methods, will be presented at checkout and include pre paid duty, tariff and tax if applicable. We do not ship to locations outside of the United States and its outlying territories. Wireframe displays can only ship within the continental United States.

Shipping Charges; Title; Risk of Loss.
Delivery of your order will be by United Parcel Service, United States Postal Service, or another carrier as determined by Luxury Light by CHS. Title to products and risk of loss or damage passes from Luxury Lights by CHS to you on Luxury Light by CHS delivery of the product to United Parcel Service or any other carrier. You must notify Luxury Light by CHS prior to shipping if you wish to obtain insurance for your order. Luxury Light by CHS will not be responsible for any failure to obtain insurance even if you have provided Luxury Light by CHS a request for such insurance.

All orders, international and domestic are shipped FOB shipping point (customer assumes responsibility for the package and its contents at the time in leaves our warehouse).

International Shipping and Shipping to Locations Outside of the Contiguous 48 Untied States
Currently, we only ship to the United States and its outlying territories including Hawaii, Alaska, Guam, Northern Mariana Islands, U.S. Virgin Islands and other United States territories. We do not ship to international locations outside of the United States. Wireframe displays cannot ship to locations outside of the continental United States.

Free Return Shipping
We offer free return shipping for a period of up to 30 days after purchase for items being returned for exchange or store credit. 

Order Cancellation
Once an order has been placed, it cannot be changed or cancelled.

Digital download items are final sales and cannot be cancelled or refunded for any reason.

Orders placed with 2-day, overnight or other expedited shipping methods cannot be cancelled under any circumstance.

Warranty Information; Limitation of Liability
Other than the warranty of title, Luxury Light by CHS makes no warranty on the products sold other than our house brand "Luxury Lights by CHS" products that we design, manufacture or direct import. You agree that any warranty applicable to a product is that of the manufacturer of the product and not Luxury Lights by CHS. Please refer to the manufacturer's product warranty information contained in the packaging, or the warranty information provided on the applicable manufacturer's website.

Neither Luxury Lights by CHS nor the product manufacturer make any warranty other than the Limited Warranty of the applicable product manufacturer. To the full extent of applicable law, Luxury Lights by CHS products 'AS IS AND WITH ALL FAULTS' and hereby disclaims all other warranties and conditions, express, implied, or otherwise, including, but not limited to, any implied warranties of fitness for a particular purpose, merchantability, or non-infringement with regard to any products.

To the full extent permitted by applicable law, neither Luxury Lights by CHS nor the product manufacturers shall be liable to you or anyone else for direct, indirect, incidental, or consequential damages, including, but not limited to, lost profits or loss of business, as the result of the failure of a product even if Luxury Lights by CHS or the product manufacturer has been advised of the possibility of such damages. The entire liability of Luxury Lights by CHS and the product manufacturers related to the use, or inability to use the products shall be limited to the purchase price of the product paid by you.

Some state and federal laws, if applicable, do not allow limitations of implied warranties or the exclusion or limitation of certain damages. You may have additional rights if these laws are applicable.

For items covered under Luxury Lights by CHS 3-year warranty we will cover the cost of shipping and replacement for any covered materially defective item for the first season of use (90 days). Beyond the first season the customer is responsible for shipping costs both ways. If there is water damage, electrical damage or other misuse scenario at any point, the warranty will immediately become void. If we receive a warranty return that turns out to not be defective, we will charge back to the customer any shipping cost we may have incurred, and we will require the customer to pay for return shipping if they want the non-defective item returned to them.

Privacy
Luxury Lights by CHS does not sell, trade, or rent your personal information to others except as hereinafter provided. This website may contain links to other sites owned or operated by third parties having their own privacy policies. Luxury Lights by CHS is not responsible for the operation or privacy policy of any third party.

In opening an account and in placing an order you are asked to furnish Luxury Lights by CHS with your contact, shipping, billing, and payment information. This information will be used by Luxury Lights by CHSto manage your account and to ship your order. Your credit card and billing information is shared with our Bank or payment service and your delivery address is given to United Parcel Service or the designated shipper. Luxury Lights by CHS may use your information to send you e-mails confirming orders, offering specials, notifying you of changes in our policies, and dealing with any order problems. Should you elect not to receive advertising or offering e-mails from Luxury Lights by CHS, you may do so by sending an e-mail to contact@luxurylightsbyCHS.com  or by simply clicking the "unsubscribe" link at the bottom of any promotional email you may receive from us.

The Luxury Lights by CHS may include promotions on its website at www.luxurylightsbychs.com from time to time that will require you to enter your email address in order to participate in the promotion. By entering your email address and participating in these promotions you agree to receive marketing and promotional emails from Luxury Lights by CHS.

What information do we collect?
We collect information from you when you register on the site, place an order, enter a contest or sweepstakes, respond to a survey or communication such as e-mail, or participate in another site feature.

When ordering or registering, we may ask you for your name, e-mail address, mailing address, phone number, credit card information or other information. You may, however, visit our site anonymously.

We also collect information about gift recipients so that we can fulfill the gift purchase. The information we collect about gift recipients is not used for marketing purposes.

Like many websites, we use “cookies” to enhance your experience and gather information about visitors and visits to our websites. Please refer to the “Do we use ‘cookies’?” section below for information about cookies and how we use them.

How do we use your information?
We may use the information we collect from you when you register, purchase products, enter a contest or promotion, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways:

  • To personalize your site experience and to allow us to deliver the type of content and product offerings in which you are most interested.
  • To allow us to better service you in responding to your customer service requests.
  • To quickly process your transactions.
  • To administer a contest, promotion, survey or other site feature.

If you would no longer like to receive promotional e-mail from us, please refer to the “How can you opt-out, remove or modify information you have provided to us?” section below. How do we protect visitor information?
We implement a variety of security measures to maintain the safety of your personal information. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above.

Do we use “cookies”?
Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. However, you can still place orders over the telephone by contacting customer service.

Do we disclose the information we collect to outside parties?
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice, except as described below. The term “outside parties” does not include Luxury Lights by CHS. It also does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

How can you opt-out, remove or modify information you have provided to us?
To modify your e-mail subscriptions, please let us know by modifying your preferences in the “My Account” section or click the “unsubscribe” link at the bottom of any of our promotional emails. Please note that due to email production schedules you may receive any emails already in production.

To delete all your online account information from our database, sign into the “My Account” section of our site and remove your shipping addresses, billing addresses & payment information. Please note that we may maintain information about an individual sales transaction in order to service that transaction and for record keeping.

Third party links
To provide you with increased value, we may include third party links on our site. These linked sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites.

Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these linked sites (including if a specific link does not work).

Mobile Terms of Service
The Luxury Lights by CHS mobile message service (the "Service") is operated by Luxury Lights by CHS. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Luxury Lights by CHS SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Luxury Lights by CHS through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Luxury Lights by CHS. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP; or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Luxury Lights by CHS mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.


We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Promotional Offers
Luxury Lights by CHS may include promotions on its website at www.luxurylightbychs.com from time to time that will require you to enter your email address in order to participate in the promotion. By entering your email address and participating in these promotions you agree to receive marketing and promotional emails from Luxury Lights by CHS.

Instead, the court shall modify, amend, or limit the provision to the extent necessary to render it valid and enforceable.

Order Acceptance

Typographic Errors
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Luxury Lights by CHS shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Luxury Lights by CHS shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Luxury Lights by CHS shall immediately issue a credit to your credit card account in the amount of the original order.

Taxes
Luxury Lights by CHS shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within any jurisdiction within which we have a physical presence or for which we have established an economic nexus. For orders shipped to other states or jurisdictions, you are solely responsible for all sales taxes or other fees, duties and taxes.

Other Conditions
These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether Luxury Lights by CHS signs them or not. We reserve the right to make changes to this site and these Conditions at any time.

Return and Refund Policy

 

Return Policy Summary:

  • 7 Days: to notify us if there is an issue with your order or installation
  • 15 Days: to ship us your item after your return request is submitted
  • No refund on installation services
  • Dec 10: No return requests or returning items accepted after December 10 for items purchased prior to December 10th each year


Manufacturing defects are not considered standard returns and are covered separately under manufacturers warranty. 

Clearance, closeout, garage sale items, DVD titles, digital downloads, video effects and closeout items are sold as is, all sales final, no returns or exchanges accepted. No returns or exchanges accepted on custom or hand made items including wireframe displays.

All returns for refund must be completed prior to December 10th. No returns for items purchase prior to December 10 of the same year will be accepted after December 10th under any circumstance.

If you placed your order with us through a 3rd party marketplace such as Walmart.com, Amazon.com or eBay - your order will not be available in our return or customer portal. Please contact the marketplace through which you placed the order and follow their return procedures.

If the order your are returning was originally shipped under a free shipping promotion and you are returning the order for a refund, the cost of the original outbound shipping for the order will be withheld from any refund due.

To be eligible for a return or exchange, your item must be in the same condition that you received it, unused, with all original packaging, accessories and documentation, and in its original unopened and un-damaged packaging. If an item is sent back to us as a return or an exchange that is not sealed in it's un-damaged, original packaging and in re-sellable condition, a 15% restocking fee will be withheld from any refund due. For exchanges, an invoice will be sent for 15% of the returning items purchase price and the exchanging items will not be shipped until the restocking fee invoice has been paid.

Do not ship items back to us using only the product packaging - items must be packaged for shipment in the same manner they were received by you. Items returned to us with shipping labels attached to the products original packaging will incur a 15% restocking fee.
